Is it illegal to sell a car if it cannot pass a smog test?

I have a '97 Ford Explorer that will not pass a smog because the engine is totally shot. I have some money saved up, but was figuring on selling my Explorer for about $500, just to get some money out of it.

Public Comments

1. i think if you state you are selling it "as is", you should be fine.
2. so long as you disclose the fact that it does not pass a smog test, you can sell it to anyone.
3. In most states. Some state's may not allow a disclosure. Probably an 02 sensor anyway.
